FATCA Compliance

On March 18, 2010, the FATCA (Foreign Account Tax Compliance Act) provisions of the HIRE Act (Hiring Incentives to Restore Employment Act of 2010) were signed into law.  The FATCA provisions are designed to mitigate offshore tax evasion through increased information reporting and tax withholding requirements. 

FATCA has its origins in the difficulties that U.S. officials have in obtaining adequate information on U.S. persons with offshore accounts, particularly with respect to those offshore accounts in countries with tax secrecy.  In particular, the qualified intermediary regime, which was implemented to assist U.S. officials in identifying the offshore accounts of U.S. persons, was believed to be inadequate to obtain the necessary information for ensuring that all U.S. persons with offshore accounts were tax compliant.  The purpose of FATCA is to provide transparency regarding the offshore financial income and assets of U.S. citizens or U.S. taxpayers.
